1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the website https://symbiotix.cloud, the mobile games, apps, websites, online features, community spaces, services, content, tools, updates, or related services offered by SymbiotixLabs LLP ("Symbiotix", "we", "our", or "us").

Ball Brawl is currently being launched by Symbiotix. These Terms are drafted to also cover future games and services released by Symbiotix unless a separate agreement is provided for a specific product.

By downloading, installing, accessing, or using our games or services, you agree to these Terms. If you do not agree, do not use our games, website, or services.

2. Eligibility and age requirements

You must be legally capable of accepting these Terms in your country or region. If you are under the legal age of majority, you may use our games and services only with permission and supervision from a parent or legal guardian.

We may restrict or block access if we believe a user is under the required age, has provided false information, or is using the services in a way that creates legal, safety, or platform compliance risk.

Parents and guardians are responsible for the activity of minors who use our games or services through their devices or accounts.

3. Scope of services

Our services may include mobile games, website pages, gameplay features, multiplayer or online features, leaderboards, achievements, events, rewards, updates, game balancing changes, advertisements, in-app purchases, community features, support channels, and future game-related services.

We may add, change, suspend, limit, or remove any feature, content, reward, virtual item, game mode, event, or service at any time for operational, creative, legal, safety, technical, business, or platform compliance reasons.

Some features may require internet access, third-party accounts, platform services, device permissions, or updated app versions.

4. Limited license to use our games and services

Subject to your compliance with these Terms, Symbiotix grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and use our games and services for your personal, non-commercial entertainment use only.

You do not receive ownership rights in our games, source code, artwork, characters, levels, designs, animations, sound, music, names, logos, tools, systems, user interface, game economy, virtual items, or related intellectual property.

We may revoke or restrict this license if you violate these Terms, misuse our services, attempt to cheat, infringe our intellectual property, break platform rules, or create risk for other users or Symbiotix.

5. Accounts, player IDs, and access

Some features may require a platform account, player ID, game profile, third-party login, or other access method. You are responsible for keeping your device, account, login information, and platform credentials secure.

You are responsible for activity that occurs through your account, device, player ID, or platform profile, unless the activity resulted from our proven fault.

We may refuse, suspend, or terminate access to accounts, player profiles, leaderboards, multiplayer services, rewards, or support channels where necessary to protect the game, other users, or our business.

6. User conduct and prohibited use

You agree that you will not:

• Use our games or services for illegal, harmful, fraudulent, abusive, or unauthorized purposes.
• Harass, threaten, abuse, defame, impersonate, or exploit another person.
• Cheat, hack, exploit bugs, manipulate matchmaking, manipulate leaderboards, use bots, scripts, automation tools, modified APKs, unauthorized clients, emulators for unfair advantage, or any other method that disrupts fair gameplay.
• Reverse engineer, decompile, disassemble, modify, copy, sell, rent, sublicense, distribute, scrape, or create derivative works from our games or services, except where allowed by applicable law.
• Access or attempt to access our systems, servers, databases, analytics, or backend services without authorization.
• Upload, transmit, or introduce viruses, malware, spyware, harmful code, or any tool that interferes with our services or user devices.
• Misrepresent your identity, affiliation, age, country, or eligibility.
• Collect data from other users without consent.
• Use our intellectual property, brand assets, screenshots, gameplay footage, or content in a misleading, harmful, or commercially exploitative way without permission.
• Use our services in a way that violates Google Play policies, platform rules, applicable laws, or these Terms.

7. Fair play, anti-cheat, and game integrity

Fair play is important to the quality of Ball Brawl and future Symbiotix games. We may monitor gameplay activity, technical signals, match data, leaderboard activity, economy activity, crash reports, and other operational information to detect cheating, fraud, abuse, bots, exploits, or security threats.

If we detect suspicious activity, we may take action including warnings, reward removal, leaderboard resets, temporary suspension, permanent ban, device or account restrictions, loss of virtual items, or other protective measures.

We are not required to disclose detailed anti-cheat methods because doing so may weaken game security.

8. User-generated content and community features

Our current or future games may include user-generated content or community features, such as usernames, player profiles, chat, clans, comments, messages, uploaded content, custom names, support messages, feedback, or other material submitted by users ("User Content").

You are responsible for your User Content. You must not submit content that is unlawful, abusive, hateful, sexually explicit, discriminatory, violent, threatening, harassing, misleading, infringing, spam, malware-related, or otherwise harmful.

If we provide UGC features, we may moderate, review, filter, remove, restrict, or report User Content and may suspend or terminate access for violations. We may also provide reporting or blocking tools where required or appropriate.

By submitting User Content, you grant Symbiotix a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to host, store, reproduce, display, modify, adapt, publish, translate, create derivative works from, and use that content for operating, improving, promoting, and protecting our games and services.

Do not submit content unless you have the necessary rights and permissions to do so.

9. Virtual items, coins, rewards, and game economy

Our games may include virtual currencies, coins, XP, skins, cosmetics, power-ups, rewards, battle passes, season rewards, unlockables, loot-style rewards, or other virtual items (collectively, "Virtual Items").

Virtual Items are licensed to you for use only within the relevant game or service. They are not your property, do not have real-money value, are not a bank deposit, are not legal tender, and cannot be sold, transferred, exchanged, refunded, or redeemed for cash unless we expressly allow it in writing or applicable law requires it.

We may change, rebalance, remove, limit, reset, or discontinue Virtual Items, rewards, prices, availability, rarity, features, or game economy systems for gameplay, technical, legal, business, fraud prevention, or balancing reasons.

If a game offers paid digital goods, in-app products, subscriptions, or virtual currency through Google Play, purchases must be handled through Google Play billing or another billing method permitted by Google Play policy in the applicable region.

10. Purchases, refunds, and subscriptions

Our games may offer free content, paid content, in-app purchases, subscriptions, ads-supported rewards, or optional digital items.

Purchases made through Google Play are also governed by Google Play terms, billing rules, refund rules, and platform policies. We do not directly control Google Play payment processing or platform refund decisions.

Unless required by law or applicable platform policy, purchases of digital goods and Virtual Items are final and non-refundable once delivered or used.

Subscription features, if introduced, will disclose the price, billing period, renewal terms, cancellation method, and included benefits before purchase. You are responsible for cancelling subscriptions through the relevant platform before renewal if you do not want to continue.

We may correct pricing errors, restrict suspicious transactions, remove fraudulently obtained items, and revoke purchases that are charged back, refunded, cancelled, or obtained through unauthorized methods.

11. Advertisements and third-party services

Our games and website may display advertisements or use third-party services for ads, analytics, crash reporting, attribution, cloud hosting, payments, social features, game services, customer support, and other operational needs.

Third-party services may have their own terms and privacy policies. Your use of third-party services may be governed by those separate terms.

We are not responsible for third-party websites, SDKs, stores, ads, payment systems, or external services except where applicable law says otherwise.

Rewarded ads, if offered, may provide in-game benefits only after successful completion and validation. We may deny, adjust, or remove rewards if there is technical failure, fraud, abuse, or platform restriction.

12. Intellectual property ownership

Symbiotix, its licensors, and its partners own all rights, title, and interest in and to our games and services, including software, code, systems, artwork, UI, characters, level designs, animations, effects, music, sounds, logos, trademarks, trade names, game mechanics, documentation, updates, and all related intellectual property.

Nothing in these Terms transfers ownership of our intellectual property to you. You may not use Symbiotix names, logos, brand assets, characters, or game content in a way that suggests sponsorship, endorsement, partnership, or ownership without our written permission.

All third-party trademarks, logos, names, and content belong to their respective owners.

13. Feedback and suggestions

If you send us ideas, suggestions, concepts, bug reports, feature requests, gameplay feedback, balancing suggestions, or other feedback, you grant Symbiotix a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, modify, develop, publish, commercialize, and incorporate that feedback into current or future games, services, technology, marketing, or business activities without compensation or obligation to you.

Do not send confidential or proprietary information as feedback unless we have signed a separate written agreement with you.

14. Updates, patches, live operations, and availability

We may release updates, patches, balance changes, events, seasons, new features, bug fixes, security updates, or content changes. Some updates may be required to continue using online features or the game itself.

We do not guarantee that any game, feature, server, leaderboard, event, reward, item, or service will always be available, uninterrupted, secure, error-free, or unchanged.

We may suspend or discontinue a game or service, fully or partly, for maintenance, technical problems, security issues, low usage, business reasons, platform requirements, legal obligations, or other reasons.

15. Privacy and data

Your use of our games and services is also governed by our Privacy Policy, which should be made available at https://symbiotix.cloud/privacy-policy or another active URL provided by Symbiotix.

The Privacy Policy explains what data we collect, how we use it, when we share it, and how users can contact us about privacy matters.

You should not use our games or services if you do not agree with our Privacy Policy.

16. Safety, legal compliance, and platform rules

You agree to comply with all applicable laws, rules, and regulations while using our games and services.

You also agree to comply with rules of platforms where our games are distributed, including Google Play, Apple App Store, payment processors, social platforms, advertising networks, and other third-party services.

If any feature, reward, content, payment method, ad, community function, or distribution method becomes restricted or prohibited by law or platform policy, we may change, suspend, or remove it.

17. Disclaimers

To the maximum extent permitted by applicable law, our games, website, content, and services are provided on an "as is" and "as available" basis.

We do not guarantee that our services will be uninterrupted, secure, accurate, compatible with every device, free of bugs, free of data loss, free of unauthorized access, or suitable for your specific expectations.

Gameplay results, matchmaking, rankings, rewards, ads, performance, and availability may vary by device, region, network, platform, version, and other conditions outside our control.

18. Limitation of liability

To the maximum extent permitted by applicable law, Symbiotix, its partners, directors, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, device issues, business interruption, or loss of virtual items arising from or related to your use of our games or services.

To the maximum extent permitted by applicable law, our total liability for any claim related to the services will not exceed the amount you paid to Symbiotix for the relevant game or service during the three months before the claim arose, or INR 1,000, whichever is lower.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

19. Indemnity

You agree to defend, indemnify, and hold harmless Symbiotix, its partners, directors, officers, employees, contractors, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of our games or services, your User Content, your violation of these Terms, your violation of law, your infringement of third-party rights, or your misuse of accounts, devices, payment systems, or platform services.

20. Termination

You may stop using our games and services at any time.

We may suspend, restrict, or terminate your access to our games or services if you violate these Terms, create risk for other users or Symbiotix, infringe rights, engage in cheating or fraud, misuse payments, violate platform policies, or where required by law.

Upon termination, your license to use the services ends immediately. You may lose access to accounts, progress, rewards, Virtual Items, online features, and other game data, subject to applicable law and platform rules.

21. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict of law principles.

Subject to applicable consumer protection laws, courts located in Delhi, India will have jurisdiction over disputes arising from or related to these Terms, our games, website, or services.

Before starting formal legal action, you agree to first contact us and attempt to resolve the issue informally.

22. Changes to these Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date and may provide notice through our website, app, store listing, or other reasonable method.

Your continued use of our games or services after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the services.
